Durante los últimos 25 años, las organizaciones de la sociedad civil y los defensores de los derechos humanos han estado en la primera línea de los esfuerzos para garantizar justicia para las víctimas de graves crímenes internacionales, incluso ante la Corte Penal Internacional y a través de su cooperación con la Corte. Lo han hecho y continúan haciéndolo con gran riesgo. Muchos defensores de derechos humanos en situaciones de países incluidos en casos de la Corte enfrentan acoso, intimidación e incluso criminalización en un esfuerzo por silenciarlos y detener su trabajo en nombre de las víctimas.

En su último período de sesiones, la Asamblea de los Estados Partes dio el importante paso de adoptar una estrategia para responder a las amenazas y ataques contra la Corte, sus funcionarios y quienes cooperan con ella. Desde entonces, la presidencia de la Asamblea y los Estados partes han condenado abiertamente los ataques contra la Corte y sus funcionarios destinados a socavar el mandato de la CPI. Esta fuerte muestra de apoyo a la Corte por parte de los Estados Partes es crucial para la capacidad de la Corte de llevar a cabo su mandato con total independencia. Pero este apoyo vocal también debería extenderse a “aquellos que cooperan” con el tribunal.

Con este fin, instamos a los Estados Partes a hacer pleno uso de la estrategia de la Asamblea para condenar las amenazas y ataques contra las organizaciones de la sociedad civil y los defensores de los derechos humanos que son blanco de ataques por su trabajo para promover la justicia ante la CPI, pedir una mayor protección y tomar medidas para fortalecer su marco interno para la protección de los defensores de los derechos humanos.

Este año, la Presidencia de la Asamblea dio un paso más al producir un conjunto de «Directrices y recomendaciones para mejorar la seguridad de los participantes en el trabajo de la Asamblea», que han sido adoptadas por la Mesa para garantizar que estas reuniones sean un espacio seguro para todo el mundo. Agradecemos a la Presidenta Fernández por su liderazgo en este importante tema y esperamos que el Presidente y la Mesa entrantes de la Asamblea lleven adelante estas discusiones esenciales.

Over the past 25 years, civil society organizations and human rights defenders have been on the front lines of efforts to ensure justice for victims of serious international crimes, including before the International Criminal Court and through their cooperation with the court. They have done that and continue to do that at great risk. Many human rights defenders in country situations across the court’s docket face harassment, intimidation, and even criminalization in efforts to silence them and stop their work on behalf of victims.

At its last session, the Assembly of States Parties took the important step of adopting a strategy to respond to threats and attacks against the court, its officials and those cooperating with it. Since then, the Assembly presidency and states parties have been vocal in condemning attacks on the court and its officials aimed at undermining the ICC’s mandate. This strong show of support for the court from its states parties is crucial to the court’s ability to carry out its mandate in full independence. But this vocal support should also be extended to “those cooperating” with the court.

To this end, we urge states parties make full use of the Assembly strategy to condemn threats and attacks against civil society organizations and human rights defenders who are targeted for their work to advance justice before the ICC, to call for their enhanced protection, and to take steps to strengthen their domestic framework for the protection of human rights defenders.

This year, the Assembly Presidency took another step forward by producing a set of “Guidelines and recommendations for enhancing the security of participants in the work of the Assembly,” which have been adopted by the Bureau, to ensure that these gatherings are a safe space for everyone. We thank President Fernandez for her leadership on this important issue and look to the incoming Assembly President and Bureau to take these essential discussions forward.
