The undersigned organizations and individuals convey to the national and international community our alarm and rejection of the «Bill for the Control, Regularization, Performance and Financing of Non-Governmental and Related Organizations», hereinafter referred to as the «Bill», in a context of attacks and harassment against the democratic society of the country, including the persecution of unions and union leaders, as well as the obstacles and prosecution of journalists and independent media.

On January 24th, 2023, the National Assembly (NA) approved in first discussion the bill, by express way, with a text without any discussion of its content and disrespecting the established procedure for the approval of laws. This bill, not published to date in any official site and known only informally, from its explanatory memorandum and in all its articles, suppresses the human right to freedom of association and closes the civic space, allowing the co-optation of the social fabric and retaliating against any autonomous associative form of Venezuelan society, in violation of international human rights treaties signed by the Venezuelan State and the national Constitution.

Should this bill be approved, Venezuelan society would be deprived of the ability and freedom to assist, organize, express, defend rights, participate in public affairs and resort to international solidarity, protection and cooperation, to face the serious human rights crisis and the complex humanitarian emergency affecting the majority of the population, in multiple sectors and areas of their lives (civil, political, labor, economic, social, humanitarian, cultural and environmental).

Among the most serious provisions of the bill are the following:

1. It declares the non-existence of all forms of non-profit associations (associations, foundations and all their forms of union), already registered [1] or operating de facto, as long as they do not adapt to the provisions of the law, once approved, violating the principle of non-retroactivity; and subjects them to a new legal regime of Statecontrol, upon compliance with a registration system, whose requirements are mandatory to have authorization, by a resolutive act issued by the competent authority. Those with foreign domicile, in addition to being authorized to work in the country, must also comply with this registration system, as provided by law.
2. The disproportionate requirementsof the new registration system, mandatory and of constant renewal, without time limits, clear evaluation criteria or due process guarantees, in case of refusals, would make compliance impossible, leaving all associations and foundations in a situation of indefinite legal insecurity. In addition to this, there are additional registration systems [2] in the hands of the State itself, which have not been implemented and which the bodies of the international human rights protection system have evaluated as instruments that violate freedom of association and the standards of civic space [3].
3. The control by the State ignores the guarantees of the essential content of the right and is deeply abusive in all areas of the exercise of the right to freedom of association. The bill considers de facto associations illegal; imposes purposes in acts and bylaws; intervenes in the composition of members and forms of self-government; restricts the geographic scope of action; and provides for State oversight of all documentation and the work of associations, to supervise, inspect, control and sanction those that do not comply with the law. All associations and foundations, and all their forms of union, de facto or de jure, are subject to obligations and sanctions, provided they are non-profit and are not regulated by special law, as well as the natural persons related to the activities under control(members, administrators, representatives, workers and other members).
4. The sanctions, in addition to being excessive and disproportionate, may be applied with broad discretion for not complying with prohibitions or incurring in imprecise or ambiguous «illicit» acts, such as: (a) «Receiving contributions intended for organizations with political purposes or carrying out political activities»; (b) «Promoting or allowing actions against national stability and the institutions of the Republic»; (c) Failing to register or not registering information required in the law, including financing from «foreign factors»; (d) Failing to keep books updated, carrying out unauthorized purposes and failing to cooperate with the State in control and oversight activities. Penalties include suspension or ex officiodissolution and confiscatory fines, in addition to civil and criminal liabilities for money laundering and terrorist financing offenses.
5. The bill creates a discriminatory differentiated regime between «Social Organizations», understood as those of a «popular community and communal» nature with the right to «convene, constitute themselves, by constitutive, collective and voluntary act», which are expressly favored with the encouragement to their performance, and the «Non-Governmental Organizations (NGOs)», which include all associations, foundations and all their forms, private law, non-profit, national or foreign, on which all the weight of the obligations of registration, authorization, supervision and penalties of the law is unloaded for «not depending on the State», being the exercise of their rights to be constituted, to function and act, subjected to the «demonstration of their capacity» and to «being authorized» by entities of the State.Considering the serious violations of the human right to freedom of association, described in the previous paragraphs, and that universal access to rights is fundamental for the construction of peace in the country and a necessary condition for the full development of a democratic society, avoiding the devastating effects of similar experiences in Latin America, we request:

– The ongoing process of approval of the bill be dismissed, including its reform or any other legal norm in the legislative agenda that goes in a similar direction, encouraging that, on the contrary, in accordance with the Venezuelan Constitution and international human rights treaties signed by the Venezuelan State, the right to the free constitution, operation, performance and formalization of legal personality of all forms of non-profit association be recognized and facilitated, in accordance with the current provisions of the Civil Code and international standards of the right to freedom of association.

– The limits of the States in international human rights treaties to establish norms that affect the right to freedom of association and the standards of a free and safe environment of civic space are respected, guaranteeing its essential contents of freedom and the autonomy of individuals to associate, of associations to carry out their purposes and of society to have associations to participate in matters that affect it, without prior authorization, restrictive requirements or abusive and unfounded interventions of denial or suspension of the right, not admissible in free and democratic societies, unduly invoking reasons of public interest, such as national security or sovereignty.

1 In Venezuela, registered non-profit associations and foundations are governed by the Civil Code, which establishes, in accordance with the Constitution, a notification procedure to formalize their legal personality, through a notarization procedure of their minutes and bylaws, before the Autonomous Service of Registries and Notaries (SAREN), attached to the Vice-Presidency of the Bolivarian Republic of Venezuela. In addition, registered non-profit associations and foundations have tax and labor obligations with the National Integrated Customs and Tax Administration Service (SENIAT) and the Venezuelan Social Security Institute (IVSS), as well as being governed by regulations established by the Superintendence of Banking Sector Institutions (SUDEBAN) in relation to their banking activities.

2 Among other records that must be compulsorily complied with are: a) the sworn statement of net worth before the Office of the Comptroller General of the Republic of representatives, members and workers (art. 14. 3) which, according to the Constitution, are only for public officers; b) the registry for integral defense, established by the Law of Enlistment and Registry for the Integral Defense of the Nation, and which is subject to (art. 14.4); and c) the registry on prevention, control, supervision and sanction of organized crime and financing of terrorism (art. 14.6).
