The civil society organizations that sign this statement reiterate our rejection and demand the revocation of new Administrative Ruling No. 002-2021 for the Unified Registry of Obligated Subjects before the National Office Against Organized Crime and Terrorism Financing (ONCDOFT), attached to the Ministry of the Interior, Justice, and Peace. The ruling was published on May 3 (Official Gazette 42,118), which replaces Administrative Ruling 001-2021, published in Official Gazette No. 42,098 of March 30, 2021.

The new Administrative Ruling 002-2021, along with other recent control and supervision measures, constitute unconstitutional acts of legal excess and serious violations of international norms for the protection of human rights and fundamental freedoms that are mandatory for the Venezuelan State for the following reasons:

1. The ruling creates an additional registry to the regulatory norms through which organizations are already registered, creating new requirements that arbitrarily exceed those established in the current legal framework. It violates the Law of Simplification of Administrative Procedures, which mandates that the State may not require the presentation of documents already in its possession. Furthermore, State-imposed obstacles and suspensions, in place for years, prevent the requirements from being met, affecting administrative procedures regarding organizations’ most basic documentation.
2. The ruling violates the principle of the presumption of innocence. Organizations are only proven to be not guilty of having links with terrorism, terrorism financing, and organized crime if they have subjected themselves to a registration system that issues a document that certifies that it is under the control and supervision of the national anti-terrorism office, which only occurs if all the requirements are met. The requirements include information on alliances with other NonProfit Organizations (NPOs) and funding sources.
3. The ruling creates a system that exacerbates discretionary controls because the requirements must be renewed each time there are changes and because it allows officials to decide whether or not requirements have been complied with. Such discretion allows for the possibility of conducting on-site audits without limits of scope or duration. This registry could also become a requirement to carry out other types of registration actions, without which the organizations will not have the ability to function. Thus, authorities would create a fence forcing organizations’ registration, who would face the penalty of falling into a situation of permanent irregularity.
4. The registry also creates an authorization regime subject to annual renewal. Only those who have obtained credentials issued by the competent Office can act as legal representatives of the organizations. Additionally, it requires that each organization have the figure of a compliance officer who registers and obtains credentials and the signing of financial statements by accountants who may require registration to stamp their signatures.

Government authorities have publicly and notoriously stated in speeches and announcements that this ruling and other measures dictated by State entities respond to a policy of criminalization, persecution, and eventually suspension and outlawing of autonomous and independent civil society organizations. Such actions violate international standards on the fight against money laundering and terrorist financing established by the Financial Action Task Force (FATF).

These standards protect the right to freedom of association under the International Covenant on Civil and Political Rights, which establishes limits for States in issuing regulations upon civil society organizations. These must be notified to international bodies of protection and strictly delimited in legislation and of a democratic nature to prevent and avoid their use to commit abuses, interrupt, or discourage the legitimate activity of human rights, development, and humanitarian organizations.

As part of this policy, in 2010, the Law for the Defense of National Sovereignty and Self-determination (Official Gazette No. 6.013 Extraordinary of 12.23.2010) was enacted. Although not yet applied, the law prohibits the use of international financing to organizations that defend the right of citizen participation. Additionally, the presidential decree of a state of exception and economic emergency is in force (No. 2323, published in Official Gazette 6227 Extraordinary of 05/13/2016), which in its article 2.8 instructs the Ministry of Foreign Affairs to audit and inspect the agreements between natural or legal persons with foreign organizations and to suspend them if their use is presumed to be for destabilizing purposes.

Especially, since 2020, a legal framework was put in place that has intensified the policy of criminalization and persecution against civil society organizations, including Decree No. 4,135 that creates the National Corps Against Terrorism as a decentralized body and Decree No. 4,136 on the National Plan Against Terrorism 2020-2022 (Official Gazette, No. 41,828 of 02.27.20. Other such laws and norms include: the creation of the Automated Registry of Non-Governmental Organizations Not Domiciled in the country, also under review requirements under the Law against Organized Crime and

Terrorism Financing (Official Gazette No. 41.994 of 10.27.20); Circular SIB-DSB-CJ-OD06524 of the Superintendency of Banks (SUDEBAN) published on November 20, 2020, to supervise the banking operations of organizations; and the International Cooperation Law, currently under discussion by the National Assembly, with which only organizations recognized by the State would have the capacity to access international cooperation

Using some of these instruments, in 2020 and 2021, raids, arrest warrants, and attempts to prosecute members of organizations such as Azul Positivo, Acción Solidaria, Prepara Familia, Fundación MAVID, Convite, Alimenta la Solidaridad, and Caracas Mi Convive were conducted.

Considering the above, we ratify our demand for the revocation of Administrative Ruling 002-2021 and any other measure adopted by the Venezuelan State that intends to or may be used to intimidate, criminalize, persecute, and shut down the work of organizations and civic space in Venezuela. This is an unacceptable situation, contrary to the need to promote participation and all solidarity efforts with Venezuelan society. Breaking social trust and further restricting international cooperation will bring more significant and unfortunate consequences of human suffering for the population, severely affected by serious human rights violations, the Covid-19 pandemic, and the multidimensional emergency that the country is experiencing.
